1. INFORMATION ABOUT OUR COMPANY AND THIS DOCUMENT
1.1 These Terms and Conditions refer and apply to each Asmana Voucher (Voucher), to be used exclusively at Asmana Wellness World, Viale Allende 10, 50013 Campi Bisenzio (Florence, Italy) ("Asmana Wellness World"). Asmana is a trademark owned by Sonosystem AG, Kriessernstr. 40, 9450 Altstätten, Switzerland. In this document, "you" or "your" refers to the purchaser or the recipient of the Voucher who is authorized to use the Voucher.
1.2 Vouchers are issued by Sonosystem AG, Kriessernstr. 40, 9450 Altstätten, Switzerland, company registration number CHE-103.329.098. In this document, "we" or "our" refers to the issuer of the voucher in question.
1.3 Asmana Wellness World is managed by Floriba srl, via Michelucci 9, 50013 Campi Bisenzio (Fi, Italy), REA (Economic Administrative Index) FI-634902, VAT number 06523800487. Floriba srl is the provider of the services specified in the Vouchers.
1.4 This document sets forth the rules to be applied between you and us, which govern the possession and use of the Vouchers.
2. VOUCHERS
2.1 A Voucher is an electronic prepaid coupon that can only be used to benefit from and/or pay for products and services within Asmana Wellness World. Vouchers cannot be used outside Asmana Wellness World. Vouchers can refer to either one or several specific services (service Voucher) or a value (value Voucher).
2.2 The expiry / validity of Vouchers is written on every voucher and usually amounts to 24 months. The expiry / duration may also be shorter in specific cases, on special occasions or for any special offers, or may have other restrictions, provided that these are indicated on the Voucher itself. Your Voucher will cease to be valid after the expiry date indicated on the Voucher itself. After that date, the Voucher will cease to operate, and you will no longer be authorized to use it.
3. THE IDENTIFICATION REQUIRED UPON PURCHASING THE VOUCHER
3.1. Value Vouchers can only be purchased via the Internet and through the website shop.asmana.ch. You must be at least 18 years old to purchase a Voucher. Before you can make a purchase, you must register and create an account.
3.2 When ordering a Voucher via the Internet, some electronic identity checks may be performed to verify your identity. When we carry out these checks, your personal information may be disclosed to Credit Reference and Fraud Prevention Agencies. These agencies can keep the information on record. This is an identity check.
3.3 The purchase or use of a Voucher will make us aware that you agree to carry out the checks provided for in this document.
3.4 We expressly reserve the right to reject your order if it is not in compliance with these Terms and Conditions. Furthermore, even if we have accepted your order, we may terminate the agreement and cancel the Voucher at any time if there is a reasonable suspicion that you have committed or are about to commit any fraud against us or any third party affiliated with us.
4. HOW TO USE A VOUCHER
4.1 A Voucher can only be used by its purchaser or can be handed in as a gift to another person.
4.2 Service Vouchers can only be used to pay for the service(s) indicated on the Voucher itself. Value Vouchers can be used for a total or partial payment of the products or services received at Asmana Wellness World. In case of partial payment, the person using the Voucher will have to pay the difference by alternative means - for example, with cash or by a debit or credit card.
4.3 To use the Voucher, just show the electronic or printed Voucher at the cash desk of Asmana Wellness World.
4.4 Some services (such as massages) require a reservation in advance for you to be able to use the service. Please contact Asmana Wellness World to book these services.
5. RESTRICTIONS ON THE USE OF VOUCHERS
5.1 Vouchers can only be used for payment of products or services within Asmana Wellness World. You are not allowed to use or attempt to use Vouchers outside Asmana Wellness World.
5.2 Value Vouchers cannot be recharged after purchase.
5.3 Vouchers cannot be used to withdraw cash or to make purchases on the Internet.
5.4 The use of a Voucher may be restricted without notice if any suspicious, fraudulent or illegal activities are identified, or if we believe that these Terms and Conditions have not been complied with, or under exceptional circumstances that prohibit the normal operation of the Voucher.
5.5. In any case, the use of and access to Asmana Wellness World are governed by the regulations of Asmana Wellness World in force: https://www.asmana.it/regolamento/
6. VOUCHER EXPIRY AND REFUND
Your Voucher will expire and automatically cease to be valid the day after the expiration date indicated on the Voucher itself. This date is defined as "valid up to". The day after this date, the Voucher will cease to operate, and you will no longer be entitled to use it. The related services (Service Voucher) can no longer be used and any balance available on the Voucher (Value Voucher) as of the expiry date will be forfeited and can no longer be used. At that point, therefore, expired Vouchers can no longer be refunded or redeemed, and you will not be entitled to any refund and/or compensation.
7. RIGHT OF WITHDRAWAL AND REFUND PROCEDURE
7.1 The purchaser of a Voucher has the right to withdraw within 14 days of the purchase of the Voucher. In any case, the refund request must be submitted at least 24 hours before the expiration date of the voucher. This right is forfeited if the Voucher has been used partially or completely.
7.2 If you wish to cancel the Voucher and withdraw from the agreement, please send an e-mail with the Voucher attached to the following address: [email protected].
7.3 Any refund will be made by returning the funds actually paid for the original purchase of the Voucher. By way of explanation, if the Voucher was purchased with a credit card, the funds will be returned by crediting the same credit card.
8. KEEPING VOUCHER DATA SAFE
8.1 You should keep your Vouchers safe. This means that you should use your best efforts to avoid the loss, theft or misuse of your Voucher(s). Do not disclose your Voucher data to anyone.
8.2 Vouchers are transferable and not personal. Any person showing a Voucher is accepted as the rightful user of the Voucher. If you have any doubt that someone has stolen your Voucher(s), please send an e-mail to [email protected] with the original receipt(s) of the Voucher(s) that has/have been sent to you by our e-shop.
9. CUSTOMER SERVICE
9.1 Any requests relating to Vouchers must be made to [email protected].
9.2 For any complaint related to Vouchers you should first contact us by using the contact details indicated above, specifying and explaining the reason for your dissatisfaction. We will record your complaint and investigate it in accordance with our Internal Complaints Procedure; once the investigation is complete, we will send a conclusive reply to your e-mail address.
10. EXCLUSION OF LIABILITY
10.1 None of the organizations described under 1.2 and 1.3 nor their employees or collaborators will be responsible for any:
- loss or damage that could not be foreseen at the time of purchase of the Voucher;
- loss or damage not resulting from a breach by Asmana or the other organizations described under 1.2 and 1.3 (each acting individually);
- corporate loss or damage and/or any loss or damage suffered by any third parties or those who are not users of the Voucher(s).
In any case, the liability of the organizations described under 1.2 and 1.3 will be limited to the amount of the Voucher as of the time of purchase.
10.2 If you have used your Voucher or have allowed your Voucher to be used fraudulently, in a manner not compliant with these Terms and Conditions, for illegal purposes, or if you have caused your Voucher or the data contained therein to be compromised due to your negligence, you will be held responsible for the use and misuse of the Voucher. We will take all reasonable and necessary steps to recover any loss and/or damage and there will be no maximum limits to your liability, subject to any applicable laws or regulations that may impose such limits. Therefore, you must pay attention to your Voucher and to its data and act responsibly, otherwise you will be held accountable.
11. PERSONAL DATA
11.2 We are authorized to collect certain information about the purchaser and the users of the voucher for the purpose of managing the voucher program. To collect personal information, Sonosystem AG is the "Data Controller". Only you are responsible for the veracity and accuracy of the personal data entered and we do not assume any responsibility in this regard.
11.3 Your personal data will be processed by all the organizations described under 1.2 and 1.3 of this document for the purpose of managing the Voucher and dealing with any requests for information about them. To provide customer service and manage your account, we can use data processors.
11.4 Unless you have given us your consent, your personal data will not be used for marketing purposes, nor will they be shared with any third parties outside the Voucher program.
11.5 By submitting the purchase order, purchasing or using the Voucher, the user accepts all the conditions of this document, as well as those specifically contained in our "PRIVACY STATEMENT" enclosed herewith regarding the use and processing of your personal data. You have the right to request the details of your personal information and data stored by us, and you can receive them by writing to Sonosystem AG, Kriessernstr. 40, 9450 Altstätten, Switzerland, attaching a valid identity document (identity card or passport).
12. CHANGES TO THIS DOCUMENT
12.1 This document “Terms and Conditions” may be changed or modified by us unilaterally and at any time, for legal, regulatory, security reasons, to allow for correct delivery or to improve the delivery of Vouchers. If any changes are made, they will be promptly made public online, usually two months before such changes take effect (unless the law requires us to make a change more quickly). The amended and updated Terms and Conditions will be made available online on shop.asmana.ch.
12.2 Given the nature of Vouchers, it is often difficult or even impossible to contact each individual holder of a Voucher in case of modifications to this document. It is therefore the responsibility of both the purchaser and the Voucher user to regularly check the website shop.asmana.ch for any changes to these Terms and Conditions. Therefore, we always assume that you hereby accept any changes to this document, unless otherwise notified by you to us. Your information in this respect will be dealt with on a case-by-case basis.

14. APPLICABLE LAW AND PLACE OF JURISDICTION
These Terms and Conditions are governed by the Swiss law, the enforcement of any mandatory foreign rules being reserved. For any dispute concerning the interpretation, execution and termination of these Terms and Conditions, the Swiss Court of the Sonosystem AG headquarters will have the exclusive jurisdiction.
